Do Arya Samaj Marriage Procedure Is Legal In India?

The Arya Samaj marriage ceremony is conducted in accordance with Vedic tradition, and the Hindu Marriage Act of 1955's requirements, along with the Arya Samaj Marriage Validation Act of 1937, gives it legal validity.

  • The groom and bride must both be at least 21 and 18 years old respectively.
  • Arya Samaj Marriage can be performed by anyone who practices Buddhism, Hinduism, Jainism, or Sikhism.
  • Arya Samaj Marriage can be performed by anyone who is not Jewish, Christian, Parsi, Muslim, or Christian.
  • If none of the parties getting married are Muslims, Christians, Parsis, or Jews, inter-caste and inter-religious marriages are also permitted in Arya Samaj marriages.
  • The Samaj permits non-Hindu couples who wish to marry to undergo a procedure known as Shuddhi, which is a sort of conversion. If Muslims, Christians, Parsis, or Jews decide to convert to Hinduism of their own free will and with their consent, the Arya Samaj Mandir will perform a ceremony known as Shuddhi, which means purification, in preparation for the conversion. Once the conversion has taken place, the convert may then get married in an Arya Samaj ceremony.

Wedding Customs and Protocol in Arya Samaj Marriages

  • Making a reservation at the Arya Samaj Mandir and submitting the necessary paperwork.
  • You will be given a wedding date by Mandir following successful registration.
  • The beginning of the wedding ceremony is the enchantment of the sacred Vedic hymn and Pandit Ji's explanation of it. The ceremony of exchanging garlands follows, with the bride presenting the husband with one first. 
  • Afterward washes his face, hands, and feet. The groom must then take part in the “madhupark se satkar” ceremony, which involves drinking honey, curd, and ghee.
  • A sacred thread is worn by the groom to start the yagna.
  • After Kanya Daan, there are holy circles around the fire.
  • 'Pratigya Mantra' follows kanya daan. They exchange wedding vows while the groom clutches the bride's hand.
  • Shilarohan, where the groom says mantras as the bride's brother lays her foot on a stone.
  • After four rounds around the fire, the bride and groom do parikrama.
  • In the Kesh Mochan tradition, the bride's hair is gently undone and let to free fall to the ground.
  • Similar to Hindus, saptapadi, or the seven holy circles, is observed around the fire.
  • The ceremony of Hridaya Sparsh, in which the pair touches each other's hearts and makes a commitment to be kind and compassionate with one another, ends with the newlyweds gazing towards the Pole Star or Dhruv.

Documents Needed to Perform an Arya Samaj Marriage

  • The bride and groom should be of legal age, which is 18 for the bride and 21 for the groom. 
  • There should be two witnesses present to witness the holy ceremony. 
  • If one of the parties is divorced, then a certified copy of the divorce decree issued by the court is required. 
  • If one of the parties is a widow, then a death certificate of the deceased spouse is required.
  • When one of the parties to a marriage is a foreign national, holds a foreign passport, or resides abroad, the other party must provide a certificate of their current marital status, a no-objection certificate from the relevant embassy, and a valid visa.

Arya Samaj Marriage: Registration

  • You can register offline with any Sub divisional Magistrate. Online registration is another choice that is offered in a select few jurisdictions, including Delhi. After fifteen days, an appointment is made.
  • Completing the registration form's requirements
  • Any document that includes the persons' dates of birth
  • One wedding photograph, two passport-size photos of each party and a marriage invitation card are optional.
  • It is required that a gazetted officer attest.
  • The district court is required to give the couple the certificate of marriage following the completion of all requirements.
  • The fee to register a marriage ranged from 100 to 200 INR.
