Court Marriage In Agra and other parts of the country is solemnised as per the Special marriage Act, 1954. The marriage is completed in the presence of a Marriage Officer and three witnesses after due procedure of law has been followed. As provided by the law, court marriage can be done by two persons irrespective of their castes, religion or creed.  

The conditions required to file for a Court Marriage-      

As provided under the section 4 of the Act of 1954, the conditions necessary to file for Court Marriage In Ahmedabad and other cities have been provided as below-

·    There shall be no persisting valid marriage of either party to any other person. However a divorcee or a widow/er can also file for court marriage.

·    The parties must have given freely consent to the marriage, thus, the parties must not be incompetent to give their consent due to unsoundness of mind or any other reason.

·     The age required for court marriage are- 21 years or more for males and 18 years or more for females.

·    The parties to the marriage must not fall within the degrees of prohibited relationship. 

Documents required for court marriage-

·        Marriage application duly signed by both the parties.

·        Receipt of application forms to be attached.

·        Age proof

·        Residential address

·        Passport size photos of the parties

·     Copy of divorce decree or death certificate of previous spouse, in case the parties are a divorcee or widow

·        An affidavit stating that the parties do not fall under the degrees of prohibited relationship 

After the filing of the application and following the due procedure of law in regards to the court marriage process, the parties on the date provided, shall declare their wish to marry the other party and sign the marriage certificate in the presence of the marriage officer and the three witnesses.  

The certificate issued after is the proof of a valid marriage of the parties.

b)    Marriage certificate

c)     Original Aadhar card of the parties

d)   Proof of the date of birth of the parties

e)    Aadhar card of two witnesses. 

·     After the lawyer, if convinced that the marriage of the couple is lawful, a petition can be filed by the parties in their respective state’s High Court for protection as provided under Section 482 of the Cr.P.C.

·     The petition could be filed for the police protection of the couple, or it could be filed for the issuance of a direction from the court to the families of the couple so as not to interfere with the life and liberty of the couple in any manner and against their wishes.
