What Is Needed For Love Marriage?

The Special marriage Act, 1954 previously known as Special Marriage Act, 1872, is a civil law which provides for the marriage of two people, irrespective of their religion, caste, place of birth or any other dissimilarity. As provided by the law, parties to the Court Marriage In Surat have the freedom to follow their local customs to solemnise their marriage as well as provide for the people who are already married to register their marriage.

Residential proof of the parties

Passport size photos of the parties

Death certificate of previous spouse in case any of the parties is a widow/er

Divorce decree in case any of the parties are divorced.

Affirmation by the parties that they are not related to each other under degrees of prohibited relationship.

Process for court marriage-

Notice- the parties to the marriage need to submit a notice to the marriage officer for the court marriage, along with the documents required as per the provisions of the law.

Publication of the notice- the Marriage Officer shall, after verifying the documents, publish the notice so submitted in his office, so that it is visible to the common public. After the notice has been published, a period of 30 days is provided to file any objection against the marriage of the parties

Objection- As provided under Section 7 of the Act, an object against the notice to marry could be raised within 30 days of publication of notice. In case, the objection raised is found to be valid by the marriage officer after inquiry, the marriage application would be cancelled, in case the objection raised is found to be invalid, then the application would be accepted and a date would be provided for signing the marriage certificate.

Declaration by the parties- three witnesses shall be present in the court, while the parties provide signature and declaration as per the third schedule in the presence of the marriage Officer.

Certificate- after the above-mentioned steps are completed, the marriage officer will provide the marriage certificate. The certificate shall be signed by the parties, witnesses and the marriage officer as well.
